1. Introduction
Welcome to Let'ssee.co (“Let'ssee”, “we”, “us” or “our”).
Let'ssee operates a digital marketplace connecting travellers, tourists and customers (“Tourists”) with independent tour guides and experience providers (“Guides”).
By creating an account, making or accepting a booking, or otherwise using Let'ssee, the user agrees to these Terms & Conditions and any policies incorporated into them.
2. Role Of Let'ssee
Let'ssee provides technology through which Tourists can discover Guides, browse experiences, view availability, make bookings, process payments, communicate regarding bookings, receive notifications and use other platform services.
Unless specifically stated otherwise, Let'ssee is not the operator of the individual tour or experience.
Guides provide their services as independent service providers.
Nothing in these Terms automatically creates an employer/employee, partnership, joint venture or agency relationship between Let'ssee and a Guide.
3. User Accounts
Users must provide accurate, current and truthful information.
Users are responsible for protecting their login credentials.
Users may not impersonate another person, create fraudulent accounts or use the platform for unlawful purposes.
Let'ssee may suspend, restrict or terminate accounts where reasonably necessary because of fraud, abuse, serious safety concerns, unlawful activity or material breaches of these Terms.
4. Guide Information And Verification
Guides may be required to provide identification, contact information, profile information, qualifications, registrations, licences, permits, banking information, insurance information and other information reasonably required by Let'ssee.
Guides remain responsible for ensuring that they hold any licences, registrations, permits, qualifications or insurance required by law for the services they provide.
Verification by Let'ssee does not constitute a guarantee of a Guide's conduct or eliminate all risks associated with an experience.
5. Bookings
Tourists may select an experience, Guide, available date and time through the platform.
A booking becomes confirmed once the platform has received the required payment confirmation and displays or communicates confirmation of the booking.
Tourists are responsible for checking the booking information before payment.
6. Multiple Bookings
Where availability permits, a Tourist may book multiple experiences with the same Guide.
Each experience may constitute a separate booking or booking component.
The platform must prevent overlapping bookings where a Guide is already unavailable.
7. Payments
The Tourist must pay the total amount displayed at checkout.
Payments may be processed by an authorised third-party payment provider.
Payment information may therefore also be processed according to that provider's applicable terms and privacy practices.
A booking may remain pending until successful payment has been confirmed.
Failed, reversed or fraudulent payments may result in cancellation or suspension of the booking.
8. Let'ssee Commission
Unless another commission has been expressly agreed, Let'ssee charges Guides a platform commission equal to 10% of the applicable booking amount.
Example:
Booking value: R1,100
Let'ssee platform commission: R110
Guide amount before other applicable adjustments: R990
Applicable refunds, chargebacks, taxes, payment-processing fees or other expressly agreed charges may affect the final amounts.
9. Guide Payouts
Guide earnings will be processed according to the payout arrangements communicated through Let'ssee.
A payout may be delayed where reasonably necessary to investigate a cancellation, refund, chargeback, suspected fraud, payment dispute, safety complaint or material booking dispute.
10. Cancellations
Bookings are subject to the separate Let'ssee Cancellation & Refund Policy.
The current standard policy is:
More than 48 hours before the scheduled experience:
100% refund.
Between 24 and 48 hours before:
Up to a 25% cancellation charge may apply and the balance will be refunded.
Less than 24 hours before:
Up to a 50% cancellation charge may apply and the balance will be refunded.
No-show:
Up to 100% of the booking amount may be retained where reasonable and lawful in the circumstances.
Any cancellation charge must remain subject to applicable South African consumer law and must be reasonable in the circumstances.
11. Guide Cancellation
If a Guide cancels a confirmed experience, the Tourist may be offered:
•a suitable replacement Guide;
•a rescheduled booking; or
•a refund.
The Tourist will not be required to accept a replacement or rescheduled experience.
Where no acceptable alternative is provided, the affected booking will ordinarily be refunded in accordance with applicable law.
12. Tourist No-shows
A Tourist who fails to arrive for a booked experience without cancelling may be classified as a no-show.
Up to 100% of the prepaid booking amount may be retained where this constitutes a reasonable cancellation charge under applicable law.
The amount should not automatically be treated as an additional charge on top of the amount already paid.
13. Guide No-shows
A Guide who fails to attend a confirmed booking without legitimate justification may:
•forfeit the relevant payout;
•receive a warning;
•have availability restricted;
•have their account temporarily suspended; or
•have their Guide account terminated in cases of repeated or serious misconduct.
The affected Tourist may receive a refund as required by applicable law and policy.
14. Exceptional Circumstances
Cancellation charges must not be applied where prohibited by applicable law.
Any legally applicable protections concerning death, hospitalisation or other protected circumstances must be respected.
Let'ssee may request reasonable supporting documentation where appropriate and lawful.
15. Weather And Unavoidable Events
Some experiences depend on weather, transport, attraction availability or other external circumstances.
Where an experience cannot safely or reasonably proceed, the Guide and Tourist may arrange a reschedule, suitable alternative or refund as appropriate.
Safety must take priority over completing an experience.
16. Safety
Users participate in experiences subject to the ordinary risks associated with the relevant activity.
Guides must exercise reasonable care and must not knowingly expose Tourists to unreasonable or undisclosed risks.
Tourists must comply with lawful and reasonable safety instructions.
Nothing in these Terms excludes liability or statutory rights where exclusion would be unlawful.
17. Insurance
Guides are responsible for determining and maintaining insurance appropriate to the services they provide and any insurance required by law.
Let'ssee may require evidence of insurance for particular experiences.
The presence of a Guide on Let'ssee does not itself constitute a guarantee that every possible loss or incident is insured.
18. Transport
If transportation is included in an experience, the Guide is responsible for complying with applicable transport, driver licensing, vehicle roadworthiness, passenger transport and insurance requirements.
19. Live Location
Let'ssee may provide optional location-sharing functionality to assist Guides and Tourists in meeting for confirmed bookings.
Location information must only be used for legitimate booking, operational and safety purposes.
Location sharing should cease when it is no longer reasonably required.
20. Chat
Private communication functionality may become available between the Tourist and Guide after the relevant booking/payment conditions have been satisfied.
Users may not use Let'ssee communications for harassment, threats, fraud, unlawful content or other prohibited conduct.
21. Reviews
Tourists may submit reviews following experiences.
Reviews must relate to genuine experiences and must not contain unlawful, fraudulent, threatening, discriminatory or deliberately misleading content.
Let'ssee may moderate or remove content that violates platform policies or applicable law.
22. User Conduct
Let'ssee does not tolerate:
•fraud;
•harassment;
•threats;
•violence;
•discrimination;
•sexual misconduct;
•deliberate deception;
•dangerous conduct; or
•unlawful activity.
Serious breaches may result in immediate account suspension or termination and may be reported to appropriate authorities where required or appropriate.
23. Personal Information
Let'ssee may process personal information necessary for accounts, bookings, payments, communications, customer support, fraud prevention, platform security and other legitimate platform functions.
Personal information must be handled in accordance with the Let'ssee Privacy Policy and applicable South African data-protection law, including POPIA.
24. Third-party Services
Let'ssee may use third-party providers for payments, maps, hosting, email, authentication, communications and other infrastructure.
Those providers may operate under their own terms and privacy policies.
25. Intellectual Property
The Let'ssee name, branding, platform design, software and original platform content may not be copied, reproduced or commercially exploited without authorisation except where permitted by law.
26. Limitation Of Liability
To the maximum extent permitted by applicable law, Let'ssee is not responsible for losses arising solely from independent acts or omissions of Guides, Tourists or unrelated third parties.
Nothing in these Terms excludes or limits liability, consumer rights or remedies where doing so would be prohibited by applicable law.
27. Disputes
Users should first report booking disputes through Let'ssee support.
Let'ssee may assist the parties in reviewing booking information, communications and payment records.
Nothing in these Terms prevents a consumer from exercising any statutory rights or approaching an appropriate regulator, tribunal or court.
28. Fraud And Chargebacks
Let'ssee may investigate suspicious transactions.
Affected payouts may be temporarily withheld while legitimate fraud, refund or chargeback investigations are conducted.
29. Account Termination
Let'ssee may suspend or terminate accounts for material breaches of these Terms, serious safety violations, fraudulent activity, unlawful conduct or repeated failure to honour confirmed bookings.
30. Governing Law
These Terms are governed by the laws of the Republic of South Africa, subject to mandatory laws applicable to individual users or transactions.
31. Future International Expansion
Let'ssee currently launches primarily in the Western Cape, South Africa.
As the platform expands into additional jurisdictions, additional local terms and legal requirements may be introduced.
